The Council met In Camera on May 14, 2024, pursuant to Section 22(2)(e) and 22(2)(g) of the Municipal Government Act. Mayor Amanda M. McDougall-Merrill called the meeting to order. Land Acknowledgement Roll Call O' Canada 1. Approval of Agenda Mayor McDougall-Merrill asked Council if it is agreed that representatives from Motionball organization make a presentation before proceeding with the remainder of the agenda items, Council agreed. Motion Moved by Councillor Gordon, seconded by Councillor Cyril MacDonald, to approve the May 28, 2024, council agenda and addendum as presented. Motion Carried Representatives from the Motionball organization presented Council with a plaque to show appreciation of the support received by the Cape Breton Regional Municipality. Proclamations and Resolutions 2.1 Bike Month Motion Moved by Councillor Eldon MacDonald, seconded by Councillor Cyril MacDonald, that CBRM Mayor Amanda M. McDougall-Merrill and Council proclaim June 2024, Bike Month in the Cape Breton Regional Municipality. Motion Carried 2.2 Motionball Month Motion Moved by Councillor Cyril MacDonald, seconded by Councillor Gillespie, that CBRM Mayor Amanda M. McDougall-Merrill and Council proclaim June 2024, Motionball Month in the Cape Breton Regional Municipality. Motion Carried 2.3 ParticipACTION Community Challenge Motion Moved by Councillor O'Quinn, seconded by Councillor Green, that CBRM Mayor Amanda M. McDougall-Merrill and Council proclaim June 2024, as the time to get moving so the Cape Breton Regional Municipality can be ParticipACTION's Community Challenge "Most Active Community" in Canada. Motion Carried 3. By-laws and Motions 3.1 Second / Final Reading - N/A 3.2 First Reading: i) CBRM Tow Truck Licencing By-law Staff Seargent Farrell reviewed the issue paper, proposed amendments of the CBRM Tow Truck Licencing By-law, and recommendation in the agenda package. Discussion took place regarding clarification of the amendments. The following motion was then put forward: Council Meeting - Minutes May 28, 2024 Approved June 25, 2024 Page 4 of 7 Motion Moved by Councillor Gordon MacDonald, seconded by Councillor Gillespie, to approve for first reading of the amended Tow Truck Licencing Bylaw, By-Law No. T-200, and schedule a Public Hearing to consider adoption of the amended Bylaw at an upcoming meeting of Council. Motion Carried 4. Planning Issues 4.1 Accessory Dwelling Units Acting Director Neville reviewed the issue paper and options included in the agenda package. The following motion was then put forward: Motion Moved by Councillor Green, seconded by Councillor MacMullin, to direct staff to include the request, amending of the Municipal Planning Strategy, in review scheduled to begin this fall of year 2024. Discussion: Process clarification Motion Carried S. Business Arising 5.1 Heritage Advisory Committee - May 16, 2024 a) Registration of 26 Archibald Ave., North Sydney Acting Director/Heritage Officer Neville reviewed the Heritage Advisory Committee issue paper and recommendation included in the agenda package. The following motion was then put forward: Motion Moved by Councillor MacMullin, seconded by Councillor Eldon MacDonald, to initiate the process for registering 26 Archibald Ave., North Sydney as a Municipal Heritage Property. Motion Carried Council Meeting - Minutes May 28, 2024 Approved June 25, 2024 Page 5 of 7 6. Corporate Services Issues 6.1 Gardiner Mines Senior Citizens and Pensioners Association/PID 15236185 Solicitor Kachafanas reviewed the issue paper and recommendation included in the agenda package. The following motion was then put forward: Motion Moved by Councillor Bruckschwaiger, seconded by Councillor Tracey, to authorize a new lease for a five-year term from the 1St day of June 2024 to the 31St day of May 2029 with the terms and conditions unchanged from the previous lease. Discussion: • Correction to typo in the agenda package to clarify it is a five-year lease; not a ten-year lease. Motion Carried 7. Council Agenda Requests 7.1 Task Force Report - Strategic Visioning Mayor McDougall-Merrill reviewed the Task Force Report and recommendations included in the agenda package. Discussion took place regarding the significant amount of work put into this report, data sheets, and the importance of continuing to implement these task forces into the future. The following motion was then put forward: Motion Moved by Councillor MacMullin, seconded by Councillor Gordon MacDonald, to accept the Task Force Report - Strategic Visioning. Motion Carried Council Meeting - Minutes May 28, 2024 Approved June 25, 2024 Page 6 of 7 7.2 Solution for Highway Line Paint Councillor Gordon MacDonald reviewed the council agenda request form included in the agenda package. Discussion took place regarding safety concerns, paint materials, requirements for line painting, and other deteriorating factors of infrastructure. The following motion was then put forward: Motion Moved by Councillor Gordon MacDonald, seconded by Councillor Gillespie, to request to the Provincial Government to find a better solution for highway line paint, that is being used on local roads, crosswalks, and highways across CBRM. Motion Carried 7.3 Policing of Provincial Highways Mayor McDougall-Merrill reviewed the letter included in the agenda package. Discussion took place regarding public safety, correspondence between CBRM and Department of Municipal Affairs and Housing, Freedom of Information and Protection of Privacy Applications, and the lack support to CBRM from senior levels of government. 8. Committee Reports - N/A 9. Review of Action Items from this Meeting Mayor Amanda M. McDougall-Merrill noted the following action items: • Stand united in the efforts of justice regarding policing of highways. • Coordinate a meeting with the Provincial Department of Public Works regarding highway maintenance, specifically line painting.
