The Council met In Camera in accordance with Section 22(2)(e) and (22)(g) of the Municipal Government Act for item number nine. Mayor Amanda M. McDougall-Merrill called the meeting to order. Land Acknowledgement Roll Call O' Canada 1. Approval of Agenda Motion Moved by Councillor Green, seconded by Councillor Paruch, to approve the May 14, 2024, council agenda as presented. Motion Carried 2. Approval of Minutes Motion Moved by Councillor O'Quinn, seconded by Councillor Tracey, to approve the CBPM Minutes from: ➢ Special Council - March 31, 2021 ➢ Emergency Council - March 10, 2023 Motion Carried At this point, Councillor Bruckschwaiger left the meeting. Proclamations 3.1 National Police Week Motion Moved by Councillor Green, seconded by Councillor O'Quinn, that CBRM Mayor Amanda M. McDougall-Merrill and Council proclaim May 12-18, 2024, as National Police Week in the Cape Breton Regional Municipality. Motion Carried 3.2 Moose Hide Campaign Day Motion Moved by Councillor O'Quinn, seconded by Councillor Green, that CBRM Mayor Amanda M. McDougall-Merrill and Council proclaim May 16, 2024, as Moose Hide Campaign Day in the Cape Breton Regional Municipality. Motion Carried 3.3 World Inflammatory Bowel Disease (IBD) Day Motion Moved by Councillor Paruch, seconded by Councillor Gillespie, that CBRM Mayor Amanda M. McDougall-Merrill and Council proclaim May 19th, 2024, as Inflammatory Bowel Disease (IBD) Day in the Cape Breton Regional Municipality. Motion Carried 3.4 Victorian Order of Nurses (VON) Week Motion Moved by Deputy Mayor Edwards, seconded by Councillor Tracey, that CBRM Mayor Amanda M. McDougall-Merrill and Council proclaim May 19-25, 2024, as VON Week in the Cape Breton Regional Municipality. Motion Carried Council Meeting - Minutes May 14, 2024 Approved June 25, 2024 Page 4 of 7 3.5 Access Awareness Week Motion Moved by Councillor Gillespie, seconded by Councillor Paruch, that CBRM Mayor Amanda M. McDougall-Merrill and Council proclaim May 26th to June 1St, 2024, as Access Awareness Week in the Cape Breton Regional Municipality. Motion Carried 3.6 Menstrual Health Day Motion Moved by Councillor MacMullin, seconded by Councillor Gordon MacDonald, that CBRM Mayor Amanda M. McDougall-Merrill and Council proclaim May 28th, 2024, as Menstrual Health Day in the Cape Breton Regional Municipality. Discussion: Importance of donating feminine products Motion Carried 4. By-laws and Motions 4.1 Second / Final Reading - Public Hearing: i) CBRM Licensing By-law for Shared Dwellings and Licence Fee Policy Peter Vandermeulen, Planner, reviewed the issue paper and recommendations in the agenda package. Mayor McDougall-Merrill called three times for any members of the public wishing to speak on the matter, no speakers came forth. The following motions were then put forward: Motion Moved by Councillor MacMullin, seconded by Councillor Paruch, final approval of the new CBRM Licensing By-law for Shared Dwellings, indicated in attachment B of the May 14, 2024, agenda package. Motion Carried Council Meeting - Minutes May 14, 2024 Approved June 25, 2024 Page 5 of 7 Motion Moved by Councillor MacMullin, seconded by Councillor Gillespie, to adopt the CBPM Fee Policy: Licensing, indicated in Attachment C of the May 14, 2024, agenda package. Motion Carried iii) Request from Tomorrow's Legends - Centennial/Bi- Centennial Complex - Portion of PIDs 15092554, 15092570, and 15538077 6:28 p.m. Director Durning reviewed the issue paper and recommendation in the agenda package. Mayor McDougall-Merrill called three times for any members of the public wishing to speak on the matter, no speakers came forth. The following motion was then put forward: Motion Moved by Councillor Paruch, seconded by Councillor Gordon MacDonald, approval of the sale of the property for $1.00, as outlined in red (Attachment A) included in the May 14, 2024, council agenda, and subject to subdivision approval and compliance to the municipal land-use bylaw. Motion Carried 4.2 First Reading - N/A S. Presentations 5.1 ABO Energy - Community Solar Opportunity Representatives of ABO Energy provided a presentation titled, "Community Solar Opportunity". Discussion took place regarding community consultation, potential subscriber costs, permits, and risk assessments. The following motion was then put forward: Council Meeting - Minutes May 14, 2024 Approved June 25, 2024 Page 6 of 7 Motion Moved by Councillor Gordon MacDonald, seconded by Councillor Paruch, to send ABO Energy a letter of support for the project submission on behalf of CBRM Council. Motion Carried 6. Corporate Services Issues 6.1 Request for Easement - NSPI Commercial Street, North Sydney (District 2) PID 15638919 Sheila Kolanko, Property Manager, reviewed the issue paper and recommendation in the agenda package. The following motion was then put forward: Motion Moved by Councillor MacMullin, seconded by Councillor Gordon MacDonald, to approve the revised plan for the Easement Agreement in favour of Nova Scotia Power Incorporation across the CBRM property (PID 15638919) to help facilitate the applicant's request. Motion Carried 7. Committee Reports 7.1 Fire and Emergency Services Committee Deputy Mayor Edwards reviewed the report in the agenda package. Discussion took place regarding clarification on joint review committee processes. For Information Only 8. Review of Action Items from this Meeting. No action items were noted for this meeting. In Camera 9.2 Tower Road Volunteer Fire Department Open meeting reconvened at 8:35 p.m. Motion Moved by Deputy Mayor Edwards, seconded by Councillor Tracey, to revoke the Certificate of Registration of Tower Road Volunteer Fire Department for cause in accordance with Section 294(5) of the Municipal Government Act due to the fact that the department does not have the required level 1 firefighters.
