CBRM A Community of Communities Cape Breton Regional Municipality Antenna Tower Procedural Policy for High Speed Internet Service in Rural CBRM SP TATEMENT OF OLICY : ? It is the policy of the Cape Breton Regional Municipality (CBRM) to facilitate the provision of high speed internet service throughout rural CBRM. 1.0 O: BJECTIVE 1 It is the objective of this policy to ensure that public notification of the planned construction of antenna towers for high speed internet service is expedited and correlated to the height of the tower. 2.0 R: ESPONSIBILITIES 2.1Seaside Communications shall provide the Development Officer with the following information: a site plan certified by a professional engineer licenced to practice ? in the Province of Nova Scotia illustrating: the specific proposed site of the tower; o the boundary of the parcel within which the tower is to be o constructed; and any other existing buildings or structures on the site. o A written description of the purpose of the structure; ? A copy of the agreement between the applicant and the property ? owner giving the applicant the permission to access the property for the purpose described in the application for a Development Permit. 1 2.2CBRM will help Seaside Communications in its responsibility to contact all assessed landowners within a distance equal to 3 times the height of the tower. 2.3Seaside Communications shall contact each assessed landowner by registered mail or courier. Each assessed landowner shall be deemed served within 3 business days of the date on the receipt for registered mail or courier. 2.4The notice to all assessed landowners shall contain a letter providing a description of the proposed structure including planned location, an illustration of the proposed structure, or a photograph of a similar structure and shall include contact information to whom any questions or concerns shall be directed. Contacts shall include both Seaside Communications and the CBRM. 2.5Seaside Communications shall provide an attestation to the CBRM when all landowners have been contacted. 2.6CBRM and Seaside Communications shall provide 14 days in which the assessed landowners may notify the Regional Municipality or Seaside Communications of any concerns or requests for further information. th 2.7On the 15 day, if no comments or concerns are received, the Regional Municipality will deem Seaside Communications as having satisfied its obligations for public consultation. 2.8If comments and concerns are received, Seaside Communications shall respond to all concerns in writing and copy the response to the Regional Municipality, or alternatively arrange a meeting with the concerned parties and the Regional Municipality within 20 days after the landowners have been served. 2.9If a meeting is held, minutes of the meeting shall be produced by Seaside Communications minimally outlining any concerns discussed and any action items to address either individual or group concerns. 2.10Seaside Communications shall respond to any action items within 10 days of the meeting with copies of responses provided to the Regional Municipality. 2.11Regional Municipality shall verify that Seaside Communications has responded to concerns and/or action items and determine if there are any follow on actions. If no further follow on actions are outstanding, the Regional Municipality shall deem Seaside Communications as having complied with its obligations for public consultation. 2.12Regional Municipality shall issue Development Permit in compliance with its Land Use By-law and provide Industry Canada with a letter stating that Seaside Communications has complied with the public consultation requirements of this Policy and that a Development Permit in compliance with CBRM’s Land Use By- law has been issued. 2 PASSED AND ADOPTED : by a majority of the whole Council at a duly called meeting of the Cape th Breton Regional Municipal Council held on January 20, 2009. ___________________________ ____________________________ MAYOR CLERK THIS IS TO CERTIFY that the attached is a true and correct copy of the Policy of the Cape Breton th Regional Municipality adopted by Regional Council during a meeting held on January 20, 2009. ___________________________ BERNIE WHITE, CLERK 3
