Summarv of Decisions - HeritaJ!e Advisorv Committee - September 12. 2005:
1. Approval of minutes Herita2e Advisory Committee June 23. 2005:
Motion to approve the Heritage Advisory Committee minutes of June 23,2005.
2. Business Arisin2 from minutes:
Ora McManus and Bob Morgan are interested in meeting with staff of the CBRM
Planning Department to rectify parking at the Lyceum.
Rick McCready will invite Paul Collins, Department of Tourism, Culture & Heritage to
attend a meeting of the Heritage Advisory Committee to discuss Municipal Heritage and
how the HAC can work with the other groups in the Community re: Heritage Properties.
3. North End Herita2e Conservation District Bylaw:
Rick gave an overview of the draft Heritage Conservation District Bylaw.
4. Sacred Heart Church. 217 Geor2e St.. Sydney - reQuest for Herita2e
Desi2nation:
It was the general consensus of the Committee to accept Rick McCready's
recommendation and request that Council designate the Sacred Heart Church at 217
George Street as a Municipal Heritage Property.
5. Update - Historic Places Initiative Contract:
Motion to accept the recommendation and appointment of Neil Libbey who will be
responsible to write a "Statement of Significance" for each heritage designated property
within CBRM.
6. Update - Provincial Herita2e Task Force:
Motion that the Heritage Advisory Committee to direct staff to prepare a presentation to
present at the Provincial Heritage Task Force public meeting in Sydney to discuss the
following: Grants available RE: Heritage (the amount of money available is not
sufficient), the process of accessing the program is slow.

Chairman Paruch welcomed the Committee with the first order of business the approval
of the June 23,2005 minutes.

3. North End Herita2:e Conservation District Bvlaw:
A copy of the revised draft North End Heritage Conservation District Bylaw was
distributed to the Committee. It was prepared by the citizens of the North End Sub
Committee. There is a map on the back showing the boundaries of the proposed district.
The bylaw has to be approved by Council. Pictures of the houses in the proposed district
will be inserted in the bylaw at a later date. The sub committee used the Truro heritage
bylaw as a guideline to develop a heritage district for the North End. In June there was
an open house held at the Lyceum for the residents and property owners of the North End
to review the proposed draft Secondary Planning Strategy for the North End and the draft
North End Heritage Conservation District Bylaw. With respect to the comments of the
residents, some responded to the drafts with positive feedback and some responded with
negative feedback. The Sisters of Holy Angels Convent supported the heritage bylaw but
had some concerns re: the Convent. The sub committee met with the Sisters a couple of
occasions to try and resolve their requests for changes to the bylaw in relation to the
Convent.
Rick gave an overview of the draft Heritage Conservation District Bylaw. He explained
if the bylaw is adopted Council then it will be the responsibility of the Development
Officer and the Heritage Officer to regulate it. If there was an application submitted for
new construction or renovations in the heritage district the application would first be
reviewed by the Development Officer who would forward it to the Heritage Officer to
determine if a Certificate of Appropriateness was required. If so, then the Heritage
Officer would process the application. If not, then the Development Officer would
process the application. A Certificate of Appropriateness is to ensure that the new
construction or renovations enhance the district. If an applicant is refused a Certificate of
Appropriateness by the Heritage Officer or by Council then the applicant can file an
appeal with the Utility Services Board.
The following two types of development would require approval of Council:

Discussion:
Citizen Spyro Trifos - raised a concern regarding whether or not lighting for properties
within the proposed HCD was addressed within the bylaw. If not, there should be some
provisions in the bylaw permitting lighting for properties that should consist of a more
traditional design instead of an industrial design.
Rick commented that lighting was not addressed in the proposed HCD bylaw and that he
would review the draft and insert provisions.
Citizen Dan MacNeil - raised the following question: What happens if the residents or
property owners do not comply with the proposed HCD bylaw?
Rick advised the Heritage Bylaw Act does not impact penalties. But if there are
violations or complaints submitted by neighbors then they will be addressed.
4. Sacred Heart Church. 217 Geor2:e St.. Sydney - request for Herita2:e
Desi2:nation:
Rick advised he received a letter from Penny Lord on behalf of the Scared Heart Parish to
designate the church as a Municipal Heritage Property including the church cemetery
located at 217 George St., Sydney.
Rick gave a brief history on the church and cemetery and explained that it scores very
high in all categories on the criteria requirement list for CBRM designation of heritage
properties. He also noted that the church is not located within the proposed heritage
conservation district for the North End of Sydney and that it requires separate
designation.
He recommended that Council designate the Sacred Heart Church at 217 George Street as
a municipal heritage property.
It was the general consensus of the Committee to accept Rick McCready's

5. Update - Historic Places Initiative Contract:
Rick updated the Committee re: the Historic Places Initiative Contract. The CBRM will
receive $4,000 from the Federal Government to employ an individual to write a
"Statement of Significance" for each heritage designated property within CBRM. Neil
Libby is the successful applicant and will take a training course in the next few weeks re:
the "Statements of Significance". Neil has written a book on the Royal Cape Breton
Yacht Club and has a passion for the area. He will be working in the Planning
Department. Of the $4,000, there will be $300 for each property and $1,000 will cover
Neil's travel expenses.

6. Update - Provincial Herita2:e Task Force:
There was a copy of a publication circulated to the Committee. The publication appeared
recently in the Cape Breton Post advising the public of a task force that is supported by
the Department of Tourism, Culture and Heritage. The task force will be conducting a
series of meetings for the public to discuss all aspects of the Province's heritage to find
out what Nova Scotians value most about their heritage and how best to manage heritage
assets.
Rick suggested that the HAC prepare a presentation to present at the public meeting in
Sydney to discuss the following two issues:
1. The grants available re: Heritage (the amount of money available is not sufficient)
2. The process of accessing the program is slow.
