HomeMy WebLinkAbout3-40 Sick Leave Cape Breton Regional Municipality Human Resource Services Policy Category: Employee Leave and Leave of Absence Number: Page: 3-40 1 of 4 Date: January 8, 1995 Approved by Council: January 23, 1996 Amended by Council: March 21, 2005 Amended by Council: March 25, 2008 Sick Leave 1.00 The Municipality provides protection for its employees against loss of income sustained due to illness or injury. Sick leave credits are paid by the Municipality and are intended to protect the employee against financial loss in the event of short term illness. 2.00 Family Leave Sick Leave will include Family Leave which provides up to two (2) days leave with pay in any calendar year for the temporary care of a sick member of the employee's family. Such leave shall be deducted from the employee's sick leave accumulation. Employees may be required to provide proof of sickness of the employee's family member. 3.00 Responsibilities 3.01 The Human Resource Department ensures: . that a uniform procedure and system is established to facilitate the administration, monitoring and recording of the leave; . that employees, department heads and managers are aware of policy and procedure covering sick leave. 3.02 Department Heads ensure: . that managers supervIsors and employees comply with policy and procedure. Category: Employee Leave and Leave of Absence Sick Leave Number: Page: 3-40 2of4 4.00 Eligibility 4.01 All regular full time employees are eligible to accumulate sick leave credits at the rate of eighteen (18) days per year to a maximum of eighty five (85) days. Regular part time employees accumulate sick leave credits on a pro-rated basis. 5.00 Sick Leave Credit Accrual 5.01 Sick leave credits will commence the month in which the employee is initially appointed. 5.02 Sick leave credits will accumulate at the rate of one and one half (1 1/2) days per month for regular full time employee and will be prorated for regular part time employees. 5.03 Sick leave credits are calculated in accordance with regular time paid. Regular time paid includes vacation, holiday, sick leave, Workers, Compensation (up to a period of six months) and any other paid leave of absence. 6.00 Payment of Sick Leave 6.01 Sick leave benefits will be paid only for excused absence and for time when the employee would normally be at work. 6.02 To be eligible for sick leave credits, the employee must report off sick to their immediate supervisor. Reporting on and off work will be in accordance with Departmental procedure. 6.03 On return to work a Leave of Absence Form (Appendix A) must be completed and signed by the immediate supervisor to authorize payment. The department head will retain this form for twelve months. 6.04 The municipality reserves the right to have an employee who is applying for sick leave examined by the CBRM Doctor. Category: Employee Leave and Leave of Absence Sick Leave Number: Pa~e: 3-40 3of4 7.00 Payout of Accumulated Sick Time 7.01 After ten years of service, upon retirement, termination or death, employees shall receive 50% of the value of accumulated sick time based on the eighty five (85) day maximum. This will be calculated at the employees rate of pay on the 1 st of the month prior to retirement, termination or death Service is defined as years of continuous service with CBRM and the employees predecessor municipality or commission. 8.00 Sick Leave Incentive 8.01 The Municipality provides a sick leave incentive plan* for its managerial and confidential employees. This plan recognizes employees who have a minimal utilization of sick leave credits 8.02 The Municipality will purchase up to five (5) percent of the employees accumulated sick leave the last pay in December of each year. The following criteria will be used, based on sick leave utilization during the period January 1, to December 31 of each year: a) Up to five (5) sick days utilized - five (5) percent of sick leave accumulation; b) Six (6) sick days utilized - four (4) percent of sick leave accumulation; c) Seven (7) sick days utilized - three (3) percent of sick leave accumulation; d) Eight (8) sick days utilized - two (2) percent of sick leave accumulation; e) Nine (9) sick days utilized - one (1%) percent of sick leave accumulation; f) Employees using more than nine (9) sick days will not qualify for the incentive. *Family Leave will not be used in determining sick leave incentive bonus entitlement 8.03 The employees sick bank accumulation will be reduced by the above percentage. 8.04 During the first year of operation, 1995, the above calculation will be pro-rated based on date of employment with the Cape Breton Regional Municipality. For example, an employee commencing employment July 1, 1995 who has used zero sick time will be entitled to 50% of 5% of their accumulated sick leave. Category: Employee Leave and Leave of Absence Sick Leave Number: Pa~e: 3-40 4of4 9.00 Employees Covered by a Collective Agreement 9.01 Sick leave credits and incentives for employees who are members of a bargaining unit will be administered in accordance with the appropriate collective agreement or policy in effect at July 31, 1995.
