CITY OF SYDNEY ORDINANCE AMENDING ORDINANCE REGULATING AND LICENSING AUTOMATIC-MACHINES,IN THE CITY OF SYDNEY, PASSED ON THE 16TH DAY OF DECEMBER, A.D., 1954 BE IT ENACTED AND ORDAINED by the City Council of Sydney, as follows: I- Section 9 of the Ordinance Regulating and Licensing Automatic Machines in the City of Sydney passed by the City Council on the 16th day of December, AMD,, .1954,, as that section is re-enacted by Section 9 of amending ordinance passed and adopted by City Council on the 20th day of December, A.D., 1962, is repealed and the following substituted therefor: 9. The following license fees together with the cost of license plates in the amount of Jifty cents (,50�) per license plate shall 'be paid to the City Clerk in the respect of every automatic machine operated or to be-operated in the City-of Sydney before any license is issued under this ordinance, and no such`license fee shall be apportioned or rebated, that is to say: (a) For every photo automatic vending machine, the sum of $25.00. (b) For every cigar and/or cigarette automatic-vending machine, the sum o f.$.25.00. (c) For every ice cream, hot food, cold food, milk, pastry, and soft drink automatic vending machine, the sum -of $15.00. (d) For ever lastic bag, tissue, soap automatic vending machine, Y P -the sum of $6.00. (e) For every kiddie's ride or mechanical amusement automatic vending machine, the sum of $12.00.. (f) For every peanut, gum, candy, popcorn automatic vending machine the sun of $5.00; in the case of penny operated machines; or the sum of $5..00 for each five cents of cost of operation for all other such machines. (g) For every juke box or s imilar automatic vending musical machine the sum of $75.00. (h) For every pinball and game machine, the sum of $100-00- (i) For every automatic washer or drier, the sum of $1.00. (j) For every automatic shoe shine, the sum of $15.00. (k) For every automatic coin scale, the sum of $5.40. (1) For every pen or pencil automatic vending machine, the sum of $5.00- for every five cents- of cost of operation of said machine. BYLAW OF THE CITY OF SYDNEY RESPECTING PARKING METERS FOR THE REGULATION OF PARKING OF VEHICLES LEFT STANDING IN THE CITY OF SYDNEY WHEREAS it is necessary to improve facilities for parking vehicles upon the public streets and highways of the City of Sydney; AND WHEREAS it is desirable that the parking of vehicles upon certain public streets and highways be regulated by the installation of parking meters upon such streets and highways or parts thereof; AND WHEREAS Section 153(1) of the Motor Vehicle Act, Chapter 293, R.S.N.S. , 1989, provides that notwithstanding Section 152, the Council of a City may, by Bylaw, prohibit or restrict the parking or leaving standing of vehicles upon any highway or part - thereof within - the limits of the City and that such regulations may prohibit or restrict the parking or leaving standing of vehicles except in accordance with a sign or device on a parking meter; THEREFORE _ in pursuance of the premises and by virtue of the power vested in the Council of the City of Sydney under provision of Section 153(1) of the Motor -Vehicle Act, the Council of the City of Sydney does hereby make the following Bylaw. I. APPLICATION The public streets and highways in the City of Sydney and parts thereof to which this Bylaw applies are those on which, under Council authority, parking meters shall have from time to time, been installed. 2. PLACING OF PARKING METERS - A parking meter installed in the City of Sydney shall be placed on the sidewalk in a location to be determined by the Traffic Authority of theC'ty of Sydney and shall designate the parking space associ ted with it as hereinafter set forth. ... 2 _ 3. PARKING SPACES The parking space provided with each meter shall be of sufficient size to be accessible and accommodate one standard passenger automobile. The placing of vehicles shall be as follows: (a) When parking is parallel to the curb or edge of the roadway, the foremost part of the vehicle shall be placed within a space measured along the curb not more than one foot beyond the meter nor more than three feet to the rear of the meter; (b) When parking is established at an angle to the edge of the roadway, this shall -be appropriately marked, signed, and unless otherwise clearly indicated, a vehicle parked at an angle where parking meters have been installed shall be placed in contact with the curb immediately to the right of a parki ng, meter, which meter shall apply to the said vehicle. (c) When two meters are supported by one standard, a vehicle shall be parked wholly within the parking space provided for each meter in a manner that no portion of the vehicle projects beyond the space. 4. LARKING of SPACE Notwithstanding anything contained in this Bylaw, special limitations of a parking space may be clearly marked and will govern the permissible location of a vehicle. It shall be an offence and a violation of this Bylaw for any- person to park or leave standing any vehicle beyond such line or marking, except as provided for in Section 5. 5. LARGE VEHICLES In the case of parallel parking, where the dimensions of a large vehicle are such that the vehicle extends into an adjacent parking space, the vehicle shall be considered to occupy all spaces so affected, and the driver shall be responsible for coin deposit in all applicable- meters. 6. INDICATION OF TINE Each parking meter installed shall have thereon an appropriate sign or device stating the parking time permitted, as hereinafter provided, in- the individual parking space to which it relates. When in operation, each parking meter shall indicate either by a dial or pointer thereon the period of time acquired by coin deposit during which parking is permitted in the parking space to which such meter relates, or by the words "legal parking" being visible in the observation window of parking meters during the said period. Either type shall , upon the expiration of the period of time permitted for parking, indicate that parking in such space is in violation of this Bylaw. 7. ' WHEN IN EFFECT Each parking meter shall bear thereon directions indicating the days and hours when the requirement to deposit coins therein shall apply, the- value of the coins to be deposited, and the limited period of time for which parking is lawfully permitted in the parking space to which such meter relates. 8. GINS When used in direction on a parking meter, the word "nickel" shall mean 5 cents; the word "dime" shall mean 10 cents; and the word "quarter" shall mean 25 cents, all of which is lawful money of Canada. The word "l oon i e" shall mean 100 cents or one dollar ($1.C4) of lawful money of Canada. In each case the amount stated shall be inclusive of C.S.T. 9. FAILURE TO DEPOSIT COIN It shall be- an offence and a violation of this Bylaw for the driver of any vehicle to park or leave the same standing in any parking space and fail to immediately deposit in the parking meter relating to such parking space a coin or coins of lawful money of Canada and of sufficient value to permit the parking or leaving standing of such vehicle in such parking space for any period of time permitted by this Bylaw and as shown by the directions set- forth on such parking meter. 4 lo. PARKING IN EXCESS OF TIME ALLOWED (a) It shall be an offence and a violation of this Bylaw for the driver of any vehicle to park or leave the same standing in any parking space regulated by a parking meter for a period of time in excess of the maximum period allowed by the directions set forth on such parking meter, regardless of the number of coins deposited or whether the word "violation", or "expired" or "time expired" is visible in the observation window of the parking meter. (b) 'When the driver of any vehicle has parked or left the same standing in any parking space for a period of time in excess of the maximum period of time allowed by the directions set forth in such parking meter, it shall be a new and separate offence for each additional hour that an offence continues. 11. COMMERCIAL MOTOR VEHICLES The driver of any commercial motor vehicle, when using the same for the transportation of goods, wares, merchandise or materials and expeditiously loading and unloading passengers or materials, may park or leave such commercial motor vehicle standing in any parking space for the purpose of loading or unloading- for any period of time not exceeding thirty minutes, without depositing any coin or coins in the parking meter relating to such parking space. 'It shall be an offence and a violation of this Bylaw for the driver -of any commercial motor vehicle to park. or leave the same standing in any parking space for any period of time in excess of thirty minutes and fail to comply with the directions set forth on the parking meter relating to such parking space. 12. UNLAWFUL TO PERMIT PARKING WITH "VIOLATION" VISIBLE ON METER It shall be an offence and a violation of this Bylaw for the driver of any vehicle to permit the same to be parked or left standing in any parking space while the words "VIOLATION", or "EXPIRED". or "TIME EXPIRED" are visible in the observation window of the parking meter relating to such parking space, unless such vehicle is parking pursuant to the provisions of Section 11 herein. 5 ._ 13. UNLAWFUL TO DEPOSIT SUBSTITUTES FOR COINS It shall be an offence and a violation of this Bylaw for any person to deposit or cause to be deposited in any parking meter installed in the City of Sydney, any device, slug, dice, metallic substance, or other substitute for the coins permitted to be deposited in accordance with this Bylaw. 14. TRAFFIC AUTHORITY TO BE IN CHARGE OF PARKING METERS The operation, maintenance, regulation, and use of all , parking meters installed in the City of Sydney shall be under the ' authority, management, supervision, and direction of the Traffic Authority for the City of Sydney. 15. ENFORCEMENT It shall be the duty of any police officer of the City of Sydney or special constable appointed for the purpose, to inspect and examine all parking meters installed and parking spaces in the City of Sydney and to report all violations to . this Bylaw. lb. PENALTY A person who is alleged to have violated this Bylaw and is given notice of the alleged violation shall pay a penalty in the amount of $8.80 for each hour of violation to the Sydney Police Department provided that if said payment is made within a period of forty-eight (48) hours following the time at which the alleged violation was committed, then the said payment shall be reduced to' $5.oo for each hour of violation and in any case, such payment shall be in full satisfaction, releasing and discharging all penalties and imprisonments incurred by the person for the violation or violations. 17. All regulations heretofore made by the Traffic Authority of the City of Sydney respecting parking meters are hereby wholly repealed on and not before the date when these regulations come into force pursuant to subsection X23 of Section 153 of the Motor Vehicle Act. .r6 _ DATED at Sydney, Nova Scotia, the/S day of A.D. 1994. BE IT ENACTED and ORDAINED by the City Council of the City of Sydney as Follows: SHORT TITLE 1. This By-Law may be cited as the "Taxi By-Law" DEFINITIONS 2. In this By-Law: (a)"Chief of Police" means the Chief of Police of the City; (b)"City" means the City of Sydney; [c]"Commission" means the Sydney Taxi Commission; (d)"Council" means the Council of the City; (e)"Inspector" means the. Inspector of Licenses appointed by the Chief of Police, and any Deputy or assistant to such Inspector duly authorized to perform the duties hereinafter set out. PART I S:Y-D-N E Y. TAX I -COMMISSION ESTABLISHMENT' 3. The Council hereby establishes the Sydney Taxi OF COMMISSION Commission. MEMBERSHIP OF 4. (1) The Commission shall consist of seven (7) COMMISSION members who shall be appointed annually in November by City Council on the recommendation of the Mayor. At least two members of the Commission shall be Aldermen of the City, two members taxi drivers licensed by the City and two members owners of a taxi business. (2) Should a member of the commission, who is an Alderman cease to be an Alderman during his term on the Commission, his appointment shall be vacated. (3) Should a vacancy occur on the Commission for any reason, the Council shall appoint a person to fill the-vacancy and the person so appointed shall hold office for the remainder of the term of the member to whose place he was appointed. (4) A member of the Commission shall be eligible for re-appointment. (5) Notwithstanding Section 4 (1) herein, the initial members ofthe Commission shall be appointed within thirty (30) days of the approval of this By-Law by the Minister of,Municipal Affairs, with an initial term extending to November, 1981. 2 - MEETINGS S.(1) The Commission shall meet within thirty (30) days of its appointment each year, and thereafter at the call of the Chairman or at the request of any two members of the Commission, (2) A quorum of the Commission for each meeting shall be three (3) members. CHAIRMAN 6.(1) The Commission shall, at its first meeting each year, elect from its members a Chairman for the coming year. VICE-CHAIRMAN (2) The Commission shall, at its first meeting each year, elect from its members a Vice-Chairman for- the ensuing year who shall act in the absence of the Chairman. APPEALS 7. The Commission shall hear appeals taken by persons whose licenses have been revoked under the provisions of this By-Law. POWERS OF THE COMMISSION ' 8. The Commis-sion may receive recommendations and submissions, conduct investigations and ultimately make recoimmendations to City Council on the following topics: (1) Rates and fees under this By-Law; (2) Limitation on the-number of taxi licenses or drivers in the City; (3) The role of the taxi ,industry in regional transportation-objectives; (4) Problems generally in the taxi industry. POLICY 9. The Comission.-shall have the ,power=undei Section...S to make recommendations to-Cozincil on changes in-this By-Law or other legislation relevant to the Taxi Industry or on Council policies which affect the Taxi Industry, but the Commission shall. have no power to resolve or mediate in individual disputes within the Taxi Industry. LICENSING CONTROL 10. The Chief of Police shall have the general control, supervision and direction over the Inspector of Licenses and- over any officer or.official acting in the carrying out of' the-various duties set out'in this By-Law. DUTIES OF 11.(1) Subject to the provisions of the Motor Vehicle INSPECTOR Act and to the provisions of Section 3 hereof and to any specific direction from time to time given or issued by. the Chief of Police, the Inspector shall have supervision over all persons lic'ensed under this By-Law and over all vehicles to which the same applies. The following shall constitute his duties under this By-Law: The Inspector shall: (a) report to the Chief of Police respecting the performance of his duties under this By-Law whenever he shall be required by the Chief of Police to do so; (b) make all necessary enquiries concerning applications for licenses or transfers thereof, as may be required to secure a due observation of the law and of this By-Law; 3 - (c) examine or cause to be examined all applicants for driver's licenses, as to their ability to operate a vehicle for transporting passengers for hire; (d) examine or cause to be examined every vehicle for which a license is requested under this By-Law; (e) submit to the Chief of Police all applications for licenses, together with his report thereon as to whether such application should be granted or not; and, should it be necessary, his recommendation for the revoking or cancelling of any license granted under this By-Law; (f) keep a register of all licenses granted under the authority of this By-Law. Such register shall contain the name or' names of the applicants, the residence of the applicants, and the date -of the license. And he shall keep such other books and records as the Chief of Police may from time-to time order; (g) when authorized by the Chief of Police, he shall cause to be-made out, and to sign, all licenses under this By-Law, the fees therefor as required under this By-Law first having been paid; (h) furnish every person applying for a license under this By-Law with a copy of the By-Law and with a card setting out the rates and fares specified in this-By-Law; - (i) ascertain-by inspection and enquiry from time to time, and-as often as may be required by the.Chief of Police, whether persons holding licenses under this By-Law continue to comply with the provisions of the law'and of this--By-Law,. (j) cause to be prosecuted all persons who shall -_offend against any of the provisions of the law or of this By-Law. 11.(2) Any act, authorized or directed by this By-Law to be done by the Inspector, may in the absence of statutory provisions contrary hereto be performed by such other officer or official as may be designated by the Chief of Police. The power and authority of the officer or official so designated shall be the same as that of the Inspector in the particular case. OWNER'S 12.(1) No vehicle shall be used for the transport of LICENSE passengers for hire unless and until the owner of such vehicle has first obtained a license. The license to be granted an owner of a vehicle to be used to transport passengers for hire shall be in the form as set out in the First Schedule to this By-Law, and shall be conspicuously displayed on the doorpost or the rear portion of the front seat of the vehicle for which it is issued. (2) A license granted' to an owner of a vehicle to- be used to transport passengers for hire shall als'd be a license to transport parcels, boxes, packages, or other articles of whatsoever nature, but excluding luggage, at the rates specified in this By-Law for the transporting'of passengers-, in the absence of a passenger or passengers in such vehicle. 4 OWNERS 13.(1) Every applicant for a license to use a vehicle QUALIFICATIONS for the transport of passengers for hire s hal l make application to the Chief of Police, in writing, in a form provided by the Chief of Police. (2) The form/application shall be approved by the Chief of Police, and shall require the applicant to supply such information concerning himself as the Chief of Police shall deem necessary to establish the qualifications of such applicant for a license. (3) In addition to the requirements -of subsection (2) of this section, each applicant, in order to receive a license, must establish to the satisfaction of the Inspector that: ' (a) he is nineteen years of age; .Y`moi _ (b) he has an adequate-knowledge of the provisions of the Nova Scotia Motor Vehicle Act and of this By-Law. REQUIREMENTS 14.(1) A license under this By-Law shall be issued FOR VEHICLE only in respect to a motor vehicle which: (a) is a four door sedan; (b) is equipped with an engine of at least four cylinders; (c) has a height from the top of the f loon to the underneath side of the roof of at .least-.44.112:inches; (d) has a width from the inside of the one door post to the inside of the door post on the opposite side of at least 51 inches; (e) has a length from the dashboard, excluding extremities, 'to the front of -the back seat,of at least 51 inches; (2) A license issued under this By-Law in respect to any motor vehicle shall state that not more than six passengers, exclusive of the driver, may be transported at any one time in such vehicle. INSURANCE 15. The owner of any motor vehicle to be licensed COVERAGE hereunder shall, with his application for a license therefor, deposit with the Chief of Police an automobile insurance policy, providing public liability insurance, passenger hazard insurance, and property damage coverage, in the amount of $244,000.00 without any limit on any particular claim up to the herein mentioned amount, regardless of the number of persons involved or the nature of the damage. LICENSE FEE 16. The fee_ payable for a license for a motor vehicle to be used for transporting passengers for hire shall be Forty Dollars ($40.00). OFFENCE AND 17. Every person who contravenes or fails to comply PENALTY with the provisions of Sections 12, 13, 14, 15, and 16 of this By-Law shall for each offence, be liable to a penalty of not more than One Hundred Dollars ($100.00); and, in default of payment, to imprisonment for a period not exceeding fourteen (14) days. DRIVER'S 18. No person shall drive any vehicle licensed LICENSE hereunder, unless "he obtains a driver's license under this By--Law, which shall be as set out in the Second Schedule to this By-Law. DRIVERS 19.(1) Every applicant for a license to drive a vehicle licensed under this By-Law shall make application to the Chief of Police, in writing, in a form provided by the Chief of Police. (2) The form of application for a driver's license under this By-Law shall be approved by the Chief of Police and shall require the applicant to supply such information concerning himself as the Chief of Police may determine to be necessary to establish the qualifications of such applicant to receive the license applied for. (3) In addition toy the requirements of subsection (2) of this section, each applicant for a driver's license under this By-Law must establish to the satisfaction of the Inspector that: (a) he is nineteen years of age (b) he has a certificate signed by a practicing Medical Doctor of the Province of Nova Scotia stating that he has had a complete Medical Examination and is free from any communicable disease and a certificate stating that he has reacted to a form of tuberculin test approved by the Minister of Public Health in such a manner as to indicate freedom from tuberculosis infection, or has had a chest x-ray indicating no active tuberculosis; (c) he has a -satisfactory knowl edge of streets, public buildings and places within and adjacent to -the City of Sydney; (d) he has, an adequate knowledge of the provisions of the Nova Scotia Motor Vehicle Act and of this By-Law. (4) Every applicant for a driver's license shall, with his application, furnish two copies of his photograph, .which shall not be retouched and shall be of a size 1 112 inch square. One copy of such photograph shall be filed in the office of the Inspector and the other shall be affixed to the license granted to the applicant under this By-Law, and shall be conspicuously displayed, together with the license on the door post or on the rear portion of the front seat in the vehicle while the same is.being operated by the holder of such license for the purpose of transporting passengers for hire. DRIVER'S LICENSE FEE 20. (1) The fee for a driver's license under this By-Law shall be-Forty Dollars ($40.00) for new applicants and Twenty'Dollars ($20.00) each year thereafter, and- shall be .submitted with the application. Applicants who fail the tests for a license-shall pay Two Dollars, ($2.00). for each subsequent test. (2) A license may be granted to a male.or a female person who meets the requirements of Section 18 of this By-Law. REFUSAL TO 21. The Chief of Police may refuse to grant a GRANT LICENSE license to any applicant, either for-an owner's license AND APPEAL or a driver's license, who,- in the judgment of the Chief of Police, is not a fit and proper person to hold such license; provided however, that any applicant who has been refused a license by the Chief of Police may appeal to the City Council,' which subject to the provisions of this by-law may confirm such,refusal or may order that a license be granted. a - PERIOD OF 22. Every license issued under this By-Law shall LICENSE relate to the period May 1st in any year to April 30th in the next succeeding year; and shall be dated the date of its issue and shall expire on the 30th day of April next succeeding the issue thereof. OFFENCE 23. Every owner of a licensed vehicle who permits UNLICENSED his vehicle to be driven by, or placed upon the stand in DRIVER_ charge of, a person not licensed under this By-Law, shall for each such offence, be liable to a penalty. OWNER TO FILE 24. (1) Every owner of a vehicle licensed under this NAMES OF By-Law and operated by a driver licensed under this DRIVERS By-Law shall file with the Inspector the name and address of each such driver employed by him, and shall notify the Inspector within seven days of any new appointments and any dismissals, or other changes in employment, of such drivers. Failure by such owner to do so shall constitute a violation of this By-Law, and such owner shall be liable to the penalty hereinafter provided. DRIVER TO (2) Every driver licensed under this By-Law who ADVISE CHANGE changes his employment to another taxi company shall OF EMPLOYMENT notify the Inspector of such change, within seven days of such change: Failure to do so by such driver shall constitute a violation of this By-Law, and such driver shall be liable to the penalty hereinafter provided. CONDITION OF 25. (1) ,Every vehicle licensed under this By-Law VEHICLE shall at.all times when-in use be kept clean and -in a sanitary condition, and in good repair. (2) The owner of any vehic l e in respect of which an application for a license is being made or of a vehicle for which -a license.has been issued and is in force, shall, when required, forthwith submit such vehicle for examination by the Inspector; and neither the owner nor the driver shall at any time prevent or hinder the Inspector from entering the vehicle for the purpose of inspecting such vehicle. (3) A vehicle licensed under this By-Law may at any time be inspected by the Chief of Police or by any person appointed by the Chief of Police, to determine that such vehicle complies with the requirements of this By-Law and with the Motor Vehicle Act. (4) Should such vehicle not meet the requirements of this Section, the Chief of Police or any person appointed by him may notify the owner of such vehicle to cease operating the same as a vehicle licensed under the authority of this By-Law until such time as the same has been put in a clean and sanitary condition and in good repair; and such owner shall thereupon cease to operate the same until permitted to do so by the Chief of Police- or by such other person appointed by the Chief of Police. DECALS 26. (1) The Inspector shall supply, without charge, to the owner-of a vehicle, licensed under this By-Law, two decals bearing the number assigned to such vehicle and the word "Taxi'% at the time of the granting of� such license. (2) The owner of a vehicle licensed under this By--Law shall affix to the front and rear bumpers of such vehicles in such a way as to be plainly visible both from the front and rear, the decal bearing the number assigned to such vehicle and the word "Taxi" issued1j. by the Inspector, and such decals shall at all times be maintained by every such owner free from foreign materials and in a condition to be clearly visible. (3) If any such decal shall become lost or defaced, additional decals may be obtained from the Inspector, upon proof satisfactory to the Inspector that such decals have in fact become lost or defaced. Upon application being made to the Inspector for any additional decals, as hereinbefore-provided. the person so applying shall, with the application, pad* the su-m of One Dollar ($1.04) for each decal required. (4) Every owner of a vehicle licensed under this By-Law who fails to comply with any of the provisions of this Section, wherein any duty is imposed upon such owner, shall for each offence be liable to a penalty of not more than One Hundred Dollars ($100..00)' and in default of ,payment, to imprisonment for a period 2D of not more than twenty ( ) days; provided, however, that it shall be a defence to-a prosecution for a violation of this Section in respect of the duty of such owner to affix such decals, if such owner has '=. previously made an application to the Inspector for any additional decals to replace any decals which have become lost or defaced, and which additional decals have not been-delivered to the owner by the Inspector. IDENTIFICATION 27. (1) The owner'of every motor vehicle licensed under this By-Law, before commencing to transport passengers for hire in such vehicle, shall affix or cause to be affixed upon the roof �f� cli.��hirre-:-afl illuminated sign. (2) Such :sign to be affixed to the roof of the licensed vehicle shall'be of such size, colour, design and style as the Chief of Police may from time to time approve; and shall display the_number assigned to- such vehicle in the license issued under this' By-Law so that such number_.s-hal l.nbe.;vis ible from-the front-and rear of the vehicle, and shall display the abbreviation "SYD" so that such abbreviation shall be visible from each side thereof. The sign shall be affixed to such vehicle in a manner approved by the Chief of Police, and shall be removed from the roof or covered by opaque material when the vehicle is not in service as a taxi. (3) Such illuminated sign shall be lit at� the same time as the headlights of the vehicle are turned on in accordance with the provisions of the Motor vehicle Act. DRESS 28. (1) Every driver of a licensed vehicle shall, at all times when engaged in the operation of the same for hire, wear a shirt or military type blouse, ankle length trousers, socks and shoes. Every driver shall be, and shall wear the required clothing, in a neat, clean, tidy condition at all times. (2) Every female driver of a licensed vehicle may, in place of ankle-length trousers, wear a skirt. (3) A driver of a.licensed,vehicle shall at all times in any public place conduct himself in an orderly manner, and he'shall nof' be noisy. He shall govern himself by regulations made by the Chief of Police from time to time concerning the conduct of drivers and the manner in which they shall ply their calling at public places. (4) The owner of a licensed vehicle or vehicles, the driver or drivers of the same,.or any person appointed by the owner for that purpose, and no other persons, may solicit passengers for such vehicle or vehicles; but no solicitation shall be made by calling out or shouting, --or in any other noisy or-disorderly manner. (5) The driver may determine whether persons may smoke, eat or drink while passengers in his vehicle and also may determine where the passenger is to sit. CHANGE OF 29. Every person licensed under this By-Law shall ADDRESS upon changing his address notify the Inspector of such change of address within SEVEN DAYS thereafter. PLACE OF 30. (1) A license for the transporting of passengers BUSINESS for hire-shal l not .be issued to the owner of any motor vehicle unless such owner shall have an established place of business other than a residence and unless the applicant shall -have a business telephone and be listed in the telephone directory under the trade name under which he-operates, or, if no such trade name, under his own name. (2) The place of business referred to in this Section may be the office or place of business of another licensee under this By-Law who provides continuous service. LOST ARTICLES 32. .Every owner or driver licensed under this By-Law shall take_ due care of all property delivered or entrusted to, and accepted by him, for conveyance or 'safekeeping-' but shall not be held responsible for any article left in his vehicle, if not entrusted to his care personally. DIRECT ROUTE 33. Every licensed driver shall proceed by the most direct, travelled route, to the point of destination, unless otherwise directed by the passenger. ORDER OF 34. (1) Every owner and driver of a vehicle licensed SERVICE under this By-Law shall accommodate the person or persons who desire.his service in the order of their applications; and', -if a licensed vehicle is not available tv give the desired service within a reasonable time, the applicant shall be so informed. (2) The owner or-driver of a licensed vehicle shall not refuse or neglect to convey in the City any orderly person or persons upon request, unless previously engaged, or unable to or prohibited by the provisions of this By 'Law. A driver may refuse to drive a person whose conduct'is disorderly or when such person's conduct may cause a driver to fear for his safetp. (3) A driver of a licensed vehicle shall convey only the person or persons engaging his vehicle, and shall not pick up other passengers while so engaged unless requested to do so by the person or persons Who engaged his services. The carrying of passengers for separate fares is prohibited. RATE SCHEDULE 35. (1) Every vehicle licensed under this By-Law shall AND POSTING OF be equipped with a taxi meter, which shall be so SAME regulated as to register and show the various charges as they accrue. (2) The rates as set out in the Third Schedule to this By-Law shall be charged for conveyance in licensed vehicle used for transporting passengers for hire, from point to point within the city limits, and the charges shall be as registered and shown on the taxi meter. (3) Copies of such Schedule of Fares on which is printed a-notice-indicating where complaints may be made shall be furnished by the Inspector to every person holding a license in respect of any vehicle used for the transporting -of passengers for hire, and a copy of such schedule shall be conspicuously posted on the door post or on the rear portion of the front seat inside the vehicle, and'shall be protected by glass or cellophane, or by some other transparent substance. (4) Every owner or driver of m a:_�pator..ueh cle,_l�:cense under this By-Law, who receives-or demands -a fare greater or less than that registered upon the taxi meter in'such vehicle, or.'not according to the rates set out in the Third Schedule -hereto, shall -be guilty of an offence under this By-Law. .SUSPENSION OF 36: (1).'The Inspectorshall have the, authority to, LICENSE AND and may suspend the license-.of any owner -or driver of APPEAL - a vehicle licensed under this By-Law who has been convicted of a violation of any of the provisions of the Criminal Code of Canada, the Nova Scotia Liquor Control Act, or the-Motor vehicle Act, or of this By-Law, which violation, in the opinion of the Inspector, renders such licensed owner or driver an unfit or improper person to hold such license, or when such owner or driver has, to the knowledge of the Inspector, committed any act or acts which, in the opinion oft he Inspector, renders such licensed owner or driver an unfit or improper person to hold such license. The Inspector shall report such suspension to the Chief of Police, who shall confirm or remove such suspension, or who may c anc e 1 such license. (2) Any person whose license has been suspended or cancelled by the Chief of Police under the authority of the preceding subsection of this section may appeal therefrom,.to the Coinission, which may review the circumstances and.may confirm such suspension or -cancellation, or may- order that such license be restored. RETURN OF 370 Where the license of any motor vehicle which is DECALS licensed to transport passengers for hire under the authority.of this By-Law has been suspended or cancelled, the owner of such vehicle shall, within three days after such suspension or cancellation, return to the Chief of Police the decals issued to him in respect of such vehicle. Failure to so return such decals within the specified time shall constitute a violation of this By-Law. PART II TAXIMETERS DUTY OF OWNER 38. (1) Every owner of a motor-drawn vehicle used in TO INSTALL the City of Sydney for transporting for hire passengers TAXIMETER within the boundaries of the City shall provide such vehicle with a. taximeter of a model approved by the Commission, and-such taximeter shall be at-all times ` in full view of the passengers and, shall be in such a condition as to show a maximum of not more than five (5%) percent in departure .from correctness -to the prejudice of any passenger. The cover and gear of such taximeter shall be kept sealed and in tact. The taximeter shall be operated from one of the front wheels of the vehicle or from the transmission and shall be illuminated by a suitable light while in operation after sundown. (2) The provisions of the preceding section shall not apply to any motor-drawn vehicle having a seating capacity for more than seven passengers or to any motor-drawn vehicle which is a public utility as defined in the Public Utilities Act or in the regulations made thereunder. INSPECTION 39. The Commission, or any person appointed by the Commission for that,purpose may at any time inspect -any- taximeter-which is installed in,a vehicle or is proposed to b4 installed and may apply such tests as may be necessary to-ascertain the accuracy of such taximeter. PENALTY 40. The owner of any=tor-drawn vehicle used for transporting for hire passengers who operates or permits -the .same to be operated for transporting for hire passengers, without the same having installed in it an approved taximeter or- in which is installed a taximeter which shows a variation in the correctness thereof, of more than five percent (5%) shall be liable to a penalty of not less than fifty dollars ($50.00) and not more than one hundred dollars ($100.00) and in default of payment of such penalty to imprisonment for a term not exceeding three (3) months. 41. (1) Any person who has used a motor-drawn vehicle in which a taximeter is installed and who refused to pay the tariff rates as shown on the taximeter shall be liable to a penalty not exceeding fifty dollars ($50.00) and in default of payment of such penalty to imprisonment for a term not exceeding twenty (20) days. (2) A peace officer may arrest without warrant any person whom he finds committing an offence, or has reason to believe has recently committed an offence against the first subsection of this section, and such peace officer making such arrest without warrant shall with reasonable diligence take the person arrested before a Stipendiary Magistrate or Justice of the.Peace to be dealt with according to law., 42. Every owner or driver of a motor-drawn vehicle who transports for hire any passengers without causing the taximeter in such vehicle to operate during the entire period of such transportation shall be guilty of an offence against this By-Law; provided however, that nothing in this section contained shall be deemed to require a'taximeter to be operated while the motor-drawn vehicle is engaged on an hourly basis as provided in the Second Schedule to this By-Law. PART III GENERAL PENALTY AND 43. (1) Every person who contravenes or fails to SUSPENSION comply with any provision of this By-Law, in respect AND APPEAL of which no other penalty is provided, shall, for each offence, be liable to a penalty not exceeding One Hundred Dollars ($100.00); and, in default of payment, to imprisonment for a period not exceeding twenty (20) days; and, in the case of any such contravention or failure.to comply, by any holder of a license under this By-Law, the Chief of Police may cancel or suspend the license of such person, but such person shall in addition be also liable to penalties above set out. (2) Any person-whose license has been cancelled or suspended may appeal to the Commission, which may confirm or disallow the action of the Chief of Police. REPEAL 44. The Motor Vehicle Taxi By-Law passed and adopted by the Council on the 4th day of August, A.D. 1947 and all amendments thereto is hereby repealed and the provisions of this By-Law substituted therefor. In this by-law the words Obarber shop" shall mean,and include any premises or part thereof wherein is carried on the trade or business of shaving, or cutting, clipping,s:ng- ing or sharapooing the hair- or scalp of a person, but .shall not include establishments where the foregoing services are render-- ed incidentally to the. trade or business of..waving or dressing the hair and which establishments are co=only known as "beauty shops" or-abeauty parlors"a ISCENSING Z.
