HomeMy WebLinkAboutRental Leases of Municipal Properties Policy Cape Breton Regional Municipality Rental Leases of Municipal Properties Excerot from Council Minutes - December 17. 1996: Motion: Moved by Councillor MacArthur, seconded by Councillor Johnston that the CAO be granted additional authority as provided for in Section 47, Cape Breton Regional Municipality Act, to negotiate and execute leases on behalf of the Municipality for a term up to and including 3 years, subject to the approval of the Corporate Services Committee and with the understanding that the Administrative Assistant bring back to the Committee appropriate guidelines for approval. Discussion: Staff were instructed to define "Agent" and bring back report to the January meeting. Motion carried. Excerot from Council Minutes - January 21.1997: Motion: Moved by Councillor MacEachern, seconded by Councillor Stubbert that where agent is referenced throughout the Rental Leases of Municipal Property Policy that Senior Management Staff of CBRM be identified as the "agent". Motion carried. January 25. 2002 NB: In a review of the attached Motion of Council dated December 17, 1996, it is noted that the attached "Policy/Motion" of Council referred to the Cape Breton Regional Municipality Act. The Cape Breton Regional Municipality Act was repealed in April, 1999 and was replaced with the Municipal Government Act (MGA). The attached Motion still has relevance in relationship to the authority granted to the CAO to enter into extended leases. The relevant section of the MGA is 31(2)(d)(iii).
