HomeMy WebLinkAboutDemoliton of Abandoned Structures Policy Caye 1jreton Xegiona{ :Municipafity Corporate Policy Title DEMOLITION OF ABANDONED STRUCTURES PURPOSE The purpose of this policy is to provide direction for the removal of abandoned structures. AUTHORIZA TION Motion of Council: August 25, 2004 GENERAL There are occasions when the owners of abandoned structures are financially unable to provide a remedy. This provides for a situation in communities where these buildings continue to deteriorate and in some cases become havens for unlawful activity. As such these properties have the potential to disrupt harmony and negatively affect surrounding property values. INSPECTION AND DETERMINATION An inspection of a complaint will be carried out in accordance with current practice for Dangerous and Unsightly Premises. The Inspector shall determine by written report the type of remedy required for the building. PERMISSION FOR DEMOLITION The CBRM, Inspectors shall obtain written permission from the property owner for the demolition of the building in the full knowledge that the costs incurred in the demolition will become a lien on the noted property. Policy Demolition of Abandoned Properties 2/2 NO PERMISSION FOR DEMOLITION Where there is no consent by the owner(s) of a property for removal of the abandoned structure the property will be taken to tax sale and tax auction. This process requires that the property be advertised for three consecutive tax sales and brought to tax auction. If the structure is not sold at tax auction the CBRM may, if in the best interests of the CBRM, vest the property at the next tax auction for the purposes of demolition. PROCEDURE On determination that the structure is an abandoned structure the Managers of Inspection- Bylaw and Financial Services shall determine the appropriate method of removal: a. Obtaining the owners permission, or b. Vesting the property through the auction process. For the purposes of demolition the Manager of Financial Services shall apply the purchasing policy. FUNDING FORMULA A base budget of 50K shall he made-available to the finance department for the removal of Abandoned Structures commencing in the fiscal period of 2005-2006. Structures will be removed using a process of prioritization. The base budget amount is to be reviewed on an annual basis. Approved by Council: August 25, 2004 2
