HomeMy WebLinkAbout4-30 Non Smoking Cape Breton Regional Municipality Human Resource Services Policy Category: Date: Workplace Standards October 17, 2001 Number Page 4-30 10f2 Approved by Council: February 12, 2002 Amended by Council: March 21, 2005 Non-Smoking Policy Objective To promote a safe and healthy working environment free, to the extent possible of tobacco smoke and to aid employees in quitting smoking. Policy Statement CBRM values its employees and is committed to providing a work environment that is safe and healthy. Medical evidence has shown that smoking is harmful to the health of smokers. It is also an irritant to non-smokers and evidence has shown that long-term exposure to secondhand smoke may seriously threaten the health of non-smokers. Therefore, the Cape Breton Regional Municipality is committed to ensuring its employees are not exposed to tobacco smoke in the workplace. The Cape Breton Regional Municipality prohibits smoking in all its workplaces as defined in this policy. Application This policy applies to all departments and employees of the Cape Breton Regional Municipality. Policy Requirements and Complaints All department heads must ensure that: no person smokes in the workplace all employees and the public are informed about the smoking prohibition in all parts of the workplace Individual employees must refrain from smoking in any part of the workplace and request visitors who are smoking to refrain from doing so in the workplace. Category: Workplace Standards Number Page 4.30 2of2 An employee who is bothered by smoking in the workplace may inform his or her immediate supervisor or department head. Upon receiving a complaint, supervisors or department heads are responsible for taking immediate action to stop the offending behavior. Discipline Discipline Action for substantiated complaints will be in accordance with the CBRM discipline policy. Smoking Cessation Programs As part of a general health promotion program, smoking cessation services for employees will be made available through the Department of Human Resources. Definitions Smoking: to smoke, hold or otherwise have control over an ignited product manufactured from tobacco and intended for use by smoking and includes but is not limited to cigarettes, cigars and tobacco pipes. Workplace - includes: (1) any municipal owned building, any municipal owned vehicle, or within 10 feet from building openings (i.e. doors, windows); (2) any indoor or enclosed space under the employer's control in which employees perform the duties of their employment. This includes any adjacent corridor, lobby, stairwell, elevator, cafeteria, washroom or other common area frequented by such employees during the course of their employment; (3) any outdoor worksites controlled by the employer or at which tasks are carried out for the employer and at which more than one employee performs the duties of his or her employment including but not limited to construction sites and parks and grounds maintenance sites and at which one or more of the employees working therein objects to smoking; and (4) in or on any municipally owned vehicle.
