HomeMy WebLinkAboutS-400 Streets bylaw CAPE BRETON REGIONAL MUNICIPALITY By-Law T1 STREETS 1. (1) Any person proposing to set out any shade or ornamental tree within the limits of any street in the Regional Municipality shall first apply for the permission of the Director of Engineering & Public Works. (2) The application shall specify the intended location of the trees. (3) The Director of Engineering & Public Works shall grant permission unless the planting will interfere with the efficient flow of traffic or will impede the view of traffic at any intersection. 2. No owner or occupant of any building shall permit water, ice or snow to pour, drip or fall from the roofs or eaves of the buildings or any part thereof upon any street or sidewalk. 3. No owner or occupant of any lands in the Regional Municipality shall permit water to flow from the lands owned or occupied on to any street or sidewalk. 4. No person shall obstruct any street or sidewalk in the Regional Municipality in any fashion whatsoever. This shall include, but not be limited to, placing snow in or upon any street or sidewalk in the Regional Municipality so as to cause any impediment to foot or vehicular passage, parking or traffic. 5. (1) No person shall erect or place any sign or other structure, whether moveable or not, within the limits of any street in the Regional Municipality. (2) Subsection (1) does not apply to a sign or awning that projects over a sidewalk or other part of the street allowance, excepting the travelled way, at a minimum height of not less than seven feet. (3) Subsection (1) does not apply to a movable sign situate on the sidewalk in front of a place of business, that relates to the business carried on within, and that does not impede the movement of pedestrians. Where a sidewalk or street has been broken or otherwise injured in consequence of the erection, demolition, alteration or repair of any building, the owner of the building shall repair the same to a standard not less than that of the adjacent sidewalk or street. 7. No person shall move any heavy load over or deposit any heavy load on any sidewalk unless the sidewalk has been first protected by a covering of boards not less than one inch thick. 8. No person shall drag any load, or permit any load or part thereof to drag, on any street in the Regional Municipality. 10. No person shall throw or deposit, or permit to be thrown or deposited, any dirt, filth, litter, rubbish or other matter on any street in the Regional Municipality. 11. Failure to comply with any of the provisions of this By-Law shall constitute a breach thereof and make the offender subject to the penalties outlined in By-law G-1 of the Cape Breton Regional Municipality, the “Penalties By-Law” so-called. 12. Any By-Law or any provision thereof passed and approved by any former Municipality within the boundaries of the County of Cape Breton prior to July 31, 1995 which conflicts with or acts contrary to the provisions of this By-Law are hereby repealed with this By- Law becoming law and any other provisions of such By-Laws hereby ratified and confirmed insofar as they are not in conflict with this By-Law.
