HomeMy WebLinkAboutS-100 Sidewalk Bylaw CAPE BRETON REGIONAL MUNICIPALITY Bylaw T4 SIDEWALKS 1. No person shall ride any horse or other animal on any sidewalk in the Regional Municipality. 2. a) If a dog, other than a guide dog (as defined herein), either leashed or unleashed, defecates on any public or private property other than the property of its owner, including upon any public sidewalk, the omission by the owner to cause such defecation to be removed immediately shall be an offence punishable on summary conviction and liable to a fine not less than $100.00 and not more than $1,000.00 on each violation. b) “Guide Dog” means any dog formally trained in a school recognized by the Canadian National Institute for the Blind (C.N.I.B.) to guide a blind person. 3. a) No person shall use rollerskates, rollerblades or skateboards on any sidewalk in the Regional Municipality. b) This section applies only to those parts of the Regional Municipality designated as downtown commercial in any land-use Bylaw in force in the Regional Municipality. c) No person shall use or operate any unauthorized vehicle of any kind on any sidewalk in the Cape Breton Regional Municipality at any time including, but not limited to the following: (i) motor vehicles as defined by the Motor Vehicles Act of Nova Scotia; (ii) snowmobiles; (iii)all terrain vehicles (ATV’s) (iv)go-carts d) The provisions of Section 3(c) shall not apply to authorized vehicles including but not necessarily limited to the following: (i)police or emergency vehicles; (ii)municipal vehicles (iii)vehicles used by contractors in the employ of the Cape Breton Regional Municipality; (iv)motorized wheel chairs used by persons under disability Sidewalk By-law Page - 2 4. Penalty – any person who contravenes or violates any provision of this Bylaw are liable upon summary conviction to a penalty, unless otherwise provided for herein, of not less than two hundred and fifty dollars ($250.00) nor more than two thousand dollars ($2,000.00) exclusive of costs, and in default of payment thereof to imprisonment for a term of not less than five (5) days nor more than ninety (90) days. 5. Any Bylaw or any provision thereof passed and approved by any former Municipality within the boundaries of the County of Cape Breton prior to July 31, 1995, which conflicts with or acts contrary to the provisions of this Bylaw are hereby repealed with this Bylaw becoming law and any other provision such Bylaws hereby ratified and confirmed insofar as they are not in conflict with this Bylaw. rd 6. Repeal – Bylaw T4 “Sidewalks” passed and adopted by the Council on 23 day of January, 1996, is hereby repealed upon this Bylaw becoming law and in full force and effect.
