Municipal Registration Fire and Emergency Services
Purpose
To establish criteria for the registration, administration and management of fire and emergency
services within the Cape Breton Regional Municipality.

Municipal Government Act (MGA) Part X Sections 294. and 295.
General
The MGA provides for the registration of fire and emergency service providers. To
meet the criteria for the provision of services the act in part states:
A municipality shall not refuse to register a body corporate that complies with this Act if
the
(a) municipality is satisfied that the body corporate is capable of providing the services
it offers to provide;
(b) body corporate carries liability insurance, as required by the municipality;
(c) body corporate does not provide the fire services for profit; and
(d) municipality does not provide the same services for the same area.

ReQistration
A fire department or emergency service provider must provide the municipality with the
list of services they intend to offer, the level in which they intend to provide these
services and the area they intend to serve. The municipality may at any time withdraw
these services for cause, or the service provider may request the same. Registration
does not make the fire or emergency service provider an agent of the municipality
additionally; the fire or emergency service provider is not a municipal enterprise pursuant
to the Municipal Finance Corporation Act.
Benefits and Conditions of ReQistration
Funding
Fire and emergency service providers registered with the CBRM may receive an
operating grant, be eligible for capital financial assistance and loan guarantees as
provided for in Council Policy.
Financial Reporting
In a format adopted by the Region, registered fire and emergency service providers are
required to provide a yearly accounting of the expenditure of funds provided by the
municipality.
Proof of Registration Compliance
Proof of continued compliance with the terms of this registration shall be submitted to the
fire service administration annually on or before the anniversary date of the incorporation
of the fire or emergency service provider. Funds, as approved by Council, will be
provided as per the semi annual funding schedule on compliance.
Operational Liability Insurance Coverage
A registered fire and/or emergency service provider will be covered under the blanket
municipal liability insurance policy for the purposes of operational service delivery.

Station Insurance
The department shall obtain and maintain insurance covering building(s), vehicle(s) and
assets directly funded by the CBRM. Departments shall also maintain general liability for
non-fire service related activities. It is recommended that Departments also maintain
Directors Liability insurance.
Proof of insurance shall be provided annually on or about the date of renewal.
Loaning of Municipal Assets
The CBRM may grant or lend assets, without charge, to a registered fire or emergency
services provider.
Operational Guidelines and Procedures
Registered fire and emergency service providers will be required to conform to Regional
service delivery operational guidelines and procedures.
Reporting to the Public
A registered fire and lor emergency service provider is required to hold a public meeting
annually to report on the status of service and service delivery.
Authority and Protection Granted under Registration
A fire or emergency service provider registered with the CBRM is authorized to exercise
the authority and is granted the protection contained in Part X Sections 297; 298; 299;
300; 301; and 302 of the MGA.

Part "A"
The fire and or emergency service provider shall provide proof of incorporation,
which includes:
a. the name of their society,
b. Joint Stocks and Bonds Registry 10,
c. the type of registration,
d. Status,
e. Status Date and registered office of the registration.
Part "B"
Affirms the request to be registered as a fire or emergency services provider and
provides an annual commitment to forward vital information on
a. registration,
b. liability; and
c. equipment insurance.
Part "C"
In the case of providing fire services, the level of service is indicated, including:
a. interior,
b. exterior attack; and
c. fire prevention programming.
The emergency service application indicates the type of emergency service
being provided.
Both fire and emergency service providers affirm the provision of said services in
a fire service area and/or emergency service response area; and their
commitment to assisting neighbouring fire service zones through preplanning
activities and formal requests.

Fire and emergency service providers must commit to maintaining adequate
equipment and training to ensure effective/efficient service delivery. In the event,
that there will be a service interruption or change in service delivery the provider
commits to immediately inform the fire service administration and the regional
communications center.
The fire and emergency service provider is also obligated to inform the Region of
any limitations.1

The Fire Department requests to be registered as the primary service provider for
the provision of emergency services as indicated in "Part C" of this document.
It is understood and agreed that annually the service provider will forward to the Cape Breton Regional Fire Administration
proof of:
a. registration with the Joint Stocks and Bonds under the Societies Act; and
b. insurance for property, equipment, and liability.
The aforementioned will be forwarded to the administration on or about the annual renewal date.

The abovementioned services are provided primarily to the fire service area known and defined as
extended to other Regional Communities through preplanning or on request ofthe authority having jurisdiction2

to provide the aforesaid services. In the event that the Fire Department is unable to continue the provision of service in part or in
whole, the Regional Municipality Fire Administration shall be notified immediately. This notification shall include the Regional
Communications Centre.
